Gay couple fights over custody of daughter after surrogate mother refuses release

Child was born in January 2015 via surrogate mother in Thailand. Her parents were unable to leave the country after the surrogate mother did not give permission.

the american Gordon Lake and her husband, the Spanish Manuel Valero, participated in a hearing this Wednesday (30) in Bangkok, Thailand, in a dispute over custody of her daughter, who was born in January last year through a surrogate mother.
 
The fight started after the surrogate mother, the young Thai woman, Patidta Kusonsrang, refused to sign the necessary documents after the birth of the baby named Carmen. Without the papers, the couple could not leave the Asian country with the child.
 
The two men, who live in Spain, have spent the last 14 months in Bangkok fighting for custody of the girl.

A Thai justiceis expected to announce a final decision on the case on April 26th.
 

The couple has another son who was born via surrogate in India. While Lake and Valero are in Thailand fighting over custody of Carmen, the other son is being looked after by Valero's sister in Spain.
 
The Asian country was a popular destination for foreign couples looking for women to be surrogates. However, after an Australian couple abandoned a baby born in the country because he was born with Down syndrome, the law was changed.
 
In February 2015, the Thai government passed a law banning foreign couples from hiring surrogates in the country. But the defense of the couple Gordon Lake and Manuel Valero maintains that their daughter was born before the law came into force.
 
A very complicated situation, which would have been avoided if the couple had opted for adoption instead of surrogacy, right?
