Another victory in the country, this time, in São Paulo. The state has just regulated same-sex marriage.
This Tuesday (18), the Court of Justice of São Paulo announced in the Diário da Justiça that the conversion of a stable union into marriage can be carried out regardless of the authorization of the Permanent Magistrate Judge. The decision applies to same-sex unions.
In addition to São Paulo, the states of Alagoas, Bahia and Piauí already allow gay marriage. The courts of Rio Grande do Sul and Mato Grosso do Sul also analyze processes that aim to facilitate the conversion.

From the Conversion of a Stable Union into Marriage
87. The conversion of the stable union into marriage must be requested by the partners before the Civil Registration Officer of Natural Persons of their domicile.
87.1. Once the application is received, the qualification process will begin under the same rite as for marriage, and the notices must state that it is a case of converting a stable union into marriage.
87.2. If the request is in order, the certificate of conversion of the stable union into marriage will be drawn up, regardless of authorization from the Permanent Magistrate Judge, dispensing with the act of celebrating the marriage.
87.3. The registration of the conversion of the stable union into marriage will be drawn up in Book “B”, stating what is determined in item
80 of this Chapter, without indicating the date of the celebration, the name of the president of the act and the signatures of partners and witnesses, whose spaces must be unused, noting in the respective term that it is a conversion of a stable union into marriage .
87.4. The conversion of the stable union will depend on overcoming the legal impediments to marriage, subject to the adoption of the matrimonial property regime, in the form and according to the precepts of civil law.
87.5. The marriage certificate converted from the stable union will not contain, under any circumstances, the start date, period or duration of this.
