Last Tuesday the 29th, Diego Ferreira de Novais was arrested in the act after masturbating and ejaculating on a passenger on a public transport bus in São Paulo. The victim was sitting, sleeping, when she was surprised by the liquid expelled by her attacker, who even bumped into another woman who was sitting next to her, as the bus passed along Avenida Paulista, towards the Ana Rosa terminal. A day later, by order of judge José Eugênio do Amaral Souza Neto, from the Barra Funda Forum, Diego, who had already been arrested five times in the police for rape, was released and will be tried in freedom. According to the judge's opinion, although it is a serious accusation, the defendant did not commit “constraint”, “nor was there any violence or serious threat” to the victim, as provided for in article 213 of the Penal Code when qualifying the act as rape. “The typical core of the crime of rape is to constrain someone, through violence or serious threat, to have sexual intercourse or to perform or allow another libidinous act to be performed with them. In this case, I understand that there was no embarrassment, nor violence or serious threat, as the victim was sitting on a bus bench when she was surprised by the Indictee's ejaculation. The act carried out by the accused is quite serious, as he masturbated and ejaculated in a full bus, on top of a passenger, who was, of course, quite nervous and traumatized”, points out the court decision. This week, the state government, in partnership with the city hall, launched a campaign to combat acts of violence and sexual abuse on public transport in São Paulo. In recent years, the number of reports of women victims of abuse on trains, subways and buses in São Paulo has increased.
