STF schedules veto trial on blood donation from gay and bi men

The STF (Supreme Federal Court) will judge next Wednesday (11) the veto that prevents members of the MSM population (men who have sex with men) from donating blood if they have had sexual relations in the last 12 months.

The action that proposes to overturn the restriction, promoted by the Public Defender and LGBT activism organizations, has been in the STF since 2016 and depends solely on the vote of the minister Gilmar Mendes.

In 2017, ministers Edson Fachin, Luís Roberto Barroso, Rosa Weber and Luiz Fux voted in favor, while Alexandre de Moraes voted the action as “partially valid”. At the end of 2019, Mendes asked for more time to decide his vote.

The lawsuit argues that preventing MSM from donating blood constitutes a case of sexual orientation discrimination.
