TST guarantees extension of benefits to Porto Alegre airline workers in case of same-sex union

Released this week, a decision by the Superior Labor Court guaranteed the validity and extension of rights for workers in the airline sector in Rio Grande do Sul, which guarantees the extension of labor benefits in the case of a stable same-sex union.

The measure favors the right of an entire professional category to equality between heterosexual and homosexual unions in relation to benefits, such as including the partner in the health plan, insurance or pension plan.

The decision taken by the Specialized Section on Collective Disputes (SDC) unanimously (nine votes to zero) took into account the understanding of the Federal Supreme Court (STF) from May 2011 that recognized the stable union of homosexuals.

During the vote, minister Walmir Oliveira da Costa, the rapporteur of the process, declared that the measure was "based on the constitutional principles of human dignity and equality that impose equal treatment to all, aiming at the construction of a free, fair society and solidarity".
